On July 10, 2020, the Supreme Court of Canada issued a split decision in a constitutional law case with interesting implications for privacy law. The Quebec government had challenged the constitutionality of Canada’s 2017 Genetic Non-Discrimination Act (the Act), arguing that it fell outside federal jurisdiction over criminal law and intruded upon areas of provincial jurisdiction.
